Personal injury cases are disputes that handle any form of damage to body, mind, or emotion by another person, business, corporation, or government agency.  Generally the plaintiff, the person who has been harmed in some way, is seeking compensation for the pain and suffering they have endured because of the actions of the defendant.  Some cases that may fall under the category of personal injury are:

  • Road Traffic Accidents
  • Accidents at Work
  • Tripping and Falling Accidents
  • Accidents in the Home
  • Product Defect Accidents
  • Medical Accidents
  • Dental Accidents

There are three different types of settlements that the defendant and plaintiff can agree on.  The first is a formal lawsuit.  Formal lawsuits take place when the plaintiff files a civil complaint against the defendant.  This is when the case is taken to court.  The second is an informal settlement which is handled by those involved in the accident, the insurance companies of those involved, and the attorneys of those involved.  Informal Settlements are usually settled with a negotiation and a written agreement for no future action from the plaintiff or the defendant.  The third is referred to as middle ground and is handled less formally than a lawsuit, but more formally than a settlement through mediation or arbitration.  Each case is handled differently based on the severity of the injury and the cause of harm.
